Terms of Service

These Terms of Service ("Terms") govern your access to and use of DOEPilot, AnalysisPilot, our websites, and related services (collectively, the "Services") provided by Onbeat Analytics LLC ("Onbeat", "we", "us", "our"). By using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts and Licenses

License. Subject to these Terms and payment of applicable fees, Onbeat grants you a non-exclusive, non-transferable, revocable license to use the Services for your internal business or personal purposes.

Account security. You are responsible for safeguarding your license key and any credentials used to access the Services. You must notify us immediately of any unauthorized use.

One user per license. Each license is intended for use by a single individual. Sharing license keys with others is prohibited.

3. Subscription Plans and Billing

Pro subscriptions. Pro plans are billed monthly or annually via Stripe. By subscribing, you authorize Onbeat to charge your payment method at the start of each billing period. A 7-day free trial may be offered to new subscribers; trials convert automatically to paid subscriptions unless canceled before the trial ends.

Student licenses. Student licenses are sold as a one-time payment of $20 and grant access for 5 months. Eligibility requires a valid .edu email address at purchase.

Educator licenses. Educator licenses are provided free of charge subject to manual verification of faculty status. Educator licenses are valid for one year and renewable at Onbeat's discretion.

Free tier. A limited-feature free tier is available without payment.

Price changes. We may change pricing for future billing periods with at least 30 days' notice. Changes do not affect your current billing period.

4. Cancellation and Refunds

You may cancel a Pro subscription at any time through the self-service portal at /doepilot/manage or /analysispilot/manage. Cancellation takes effect at the end of the current billing period; you retain access until then.

Refund policy. We offer a 14-day refund for new annual subscriptions and the first monthly subscription. Refunds beyond this window are issued at our discretion. Student one-time payments are non-refundable after 7 days. To request a refund, contact billing@onbeatanalytics.com.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the Services, except where permitted by law
• Resell, sublicense, or commercially exploit the Services
• Use the Services to violate any law or infringe any third party's rights
• Probe, scan, or test the vulnerability of the Services without written permission
• Use the Services to send unsolicited communications
• Use automated means (scrapers, bots) to access the Services in a way that places excessive load on our infrastructure

We may suspend or terminate access for violations.

6. Intellectual Property

The Services and all related content, software, and trademarks are the property of Onbeat or our licensors. These Terms grant you no rights to our intellectual property other than the limited license described in Section 2.

Any feedback, suggestions, or ideas you submit may be used by Onbeat without obligation or compensation to you.

7. Privacy

Your use of the Services is also governed by our Privacy Policy.

8. Third-Party Services

The Services integrate with third-party providers (Stripe, etc.). Onbeat is not responsible for third-party services and their respective terms govern your use of them.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. Onbeat disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

While we design the Services for engineering and analytical work, you are responsible for verifying the correctness of any results before relying on them for production, safety, or regulatory decisions.

10. Limitation of Liability

To the maximum extent permitted by law, Onbeat's total liability arising from or related to the Services shall not exceed the greater of (a) $100 or (b) the fees you paid Onbeat in the 12 months preceding the claim.

Onbeat is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.

11. Indemnification

You agree to indemnify and hold harmless Onbeat from any claims, damages, or expenses arising from your violation of these Terms, your misuse of the Services, or your violation of third-party rights.

12. Termination

We may suspend or terminate your access to the Services at any time for material breach of these Terms. You may stop using the Services at any time. Sections 6, 9-13 survive termination.

13. Governing Law

These Terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms shall be brought exclusively in the state or federal courts located in Ada County, Idaho.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or via a notice on our websites at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
